Terms of Service

1. Acceptance of Terms

By accessing or using Byndr ("the Service"), available at https://byndr.cards, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

These Terms constitute a legally binding agreement between you and Clemens Huck ("we", "us", "our"), operating as Byndr, based in Germany.

2. Description of the Service

Byndr is a web-based platform for managing trading card game (TCG) collections. The Service allows you to track cards, set collecting goals, monitor estimated market values, explore TCG sets, and interact with gamification features such as VaultCards and Quartett.

The Service is provided free of charge. We reserve the right to introduce paid features or tiers in the future, which will be clearly communicated in advance.

3. Account Registration

To use certain features of the Service, you must create an account using an email address or a supported third-party authentication provider (Google, GitHub). You agree to:

·Provide accurate and complete registration information
·Keep your login credentials secure and confidential
·Notify us immediately of any unauthorized access to your account
·Accept responsibility for all activity that occurs under your account

You must be at least 16 years of age to create an account. By registering, you confirm that you meet this age requirement.

4. Acceptable Use

You agree not to use the Service to:

Violate any applicable law, regulation, or third-party rights
Upload or transmit malicious code, spam, or harmful content
Attempt to gain unauthorized access to other users’ accounts or data
Reverse-engineer, scrape, or systematically extract data from the Service beyond what is provided through our public API
Impersonate another person or misrepresent your affiliation
Use the Service for any commercial purpose not expressly authorized by us
Circumvent rate limits, security measures, or access controls

We reserve the right to suspend or terminate accounts that violate these terms, with or without prior notice.

5. Your Content and Data

You retain ownership of all data you create within the Service, including collection projects, card entries, and any associated metadata.

By using the Service, you grant us a limited, non-exclusive license to store, process, and display your data solely for the purpose of providing and improving the Service. We will not sell, share, or use your personal collection data for advertising purposes.

If you choose to use the public API to share your collection data with third parties, you do so at your own discretion and responsibility.

6. Intellectual Property

The Service, including its design, code, branding, and editorial content (set guides, blog posts, chase card descriptions), is owned by Clemens Huck and protected by applicable intellectual property laws.

Trading card names, images, and related trademarks belong to their respective owners (The Pokémon Company, Bandai/Shueisha, Wizards of the Coast, etc.). Byndr is not affiliated with, endorsed by, or sponsored by any TCG publisher. Card data displayed on the platform is sourced from publicly available APIs for informational purposes.

7. Market Prices and Valuations

The estimated market prices displayed on Byndr are sourced from third-party pricing APIs and are provided for informational purposes only. They do not constitute financial advice, appraisals, or guarantees of value.

Actual card values may vary based on condition, grading, market conditions, and other factors. We are not responsible for any financial decisions made based on the price data displayed on our platform.

8. Public API

Byndr provides a public API for programmatic access to your own collection data. By using the API, you agree to:

·Respect the rate limits (100 requests per hour per API key)
·Keep your API keys confidential and not share them publicly
·Use the API only to access your own data or data you are authorized to access
·Not use the API to build a competing service or to systematically replicate the platform

We may modify, rate-limit, or discontinue the API at any time. We will make reasonable efforts to communicate breaking changes in advance.

9. Service Availability

We strive to keep the Service available at all times, but we do not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

We are not liable for any loss or damage resulting from service interruptions, data loss, or technical issues, to the extent permitted by law.

10. Limitation of Liability

To the fullest extent permitted by applicable law, Byndr and its operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, revenue, or profits, arising from your use of or inability to use the Service.

Our total aggregate liability for any claim arising from or related to the Service shall not exceed the amount you have paid us in the twelve months preceding the claim (which, for free-tier users, is zero).

Nothing in these Terms excludes or limits liability for fraud, gross negligence, or any liability that cannot be excluded under applicable law.

11. Termination

You may delete your account at any time. Upon deletion, your personal data and collection data will be permanently removed in accordance with our Privacy Policy.

We may suspend or terminate your account if you violate these Terms, engage in abusive behavior, or if we are required to do so by law. Where possible, we will provide notice and an opportunity to export your data before termination.

12. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated effective date. For material changes, we will notify registered users by email at least 14 days before the changes take effect.

Continued use of the Service after changes become effective constitutes acceptance of the updated Terms.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Federal Republic of Germany. Any disputes arising from or in connection with these Terms shall be subject to the jurisdiction of the competent courts in Germany.

For consumers residing in the EU, mandatory consumer protection provisions of your country of residence apply where they provide a higher level of protection.

The European Commission provides an online dispute resolution platform at ec.europa.eu/consumers/odr. We are not obligated and generally not willing to participate in dispute resolution proceedings before a consumer arbitration board.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced by a valid provision that most closely reflects the original intent.
